Terms of Service

EmoTales turns a child's emoji picks into an original bedtime story. Here's exactly the guidelines and agreement for using our Service.

📋

THE 60-SECOND VERSION

  • Only an adult may create a Parent Account. Children use the app only through a Child Profile the parent sets up and controls.
  • Subscriptions renew automatically until cancelled; you can cancel anytime from the Parent Dashboard.
  • Stories are generated automatically by AI — they're filtered for age-appropriateness but not individually human-reviewed, so we recommend reading along with younger children.
  • Parents own the stories their family creates and can use them personally (print, save, share within the family).

01Acceptance of terms

These Terms of Service ("Terms") form an agreement between you, as a Parent or legal guardian, and EmoTales ("EmoTales," "we," "us") governing your use of the EmoTales website and app (the "Service"). By creating a Parent Account, you accept these Terms and confirm you have read the Privacy Policy above.

02Who can use EmoTales

  • A Parent Account may only be created by someone who is at least 18 years old, or the age of legal majority in their jurisdiction, and who is the parent or legal guardian of any child using a Child Profile on that account.
  • A child may only use EmoTales through a Child Profile created and supervised by their Parent. A child may not create, register, or hold a Parent Account.
  • By creating a Child Profile, the Parent confirms they have the authority to consent, on the child's behalf, to the collection and use of information described in the Privacy Policy.

03Account structure

EmoTales uses a two-layer account model:

  • Parent Account — created with an email, password, and a PIN. Controls billing, settings, and all Child Profiles.
  • Child Profile(s) — created inside a Parent Account, using a nickname, age range, and avatar. Switching out of a Child Profile, or reaching any account or billing setting, requires the Parent Account PIN.

You are responsible for keeping your password and PIN confidential and for all activity that occurs under your Parent Account, including any Child Profile within it.

04The Service

EmoTales lets a child select a sequence of emoji, which our Service uses — with the help of an AI story-generation provider — to create an original, age-appropriate short story for that child to read or have read to them. Available features (such as narration, illustrations, or story length) may vary by subscription plan and may change over time as we improve the Service.

05Subscription plans & billing

5.1 Plans

EmoTales offers a free tier with limited story generation, and one or more paid subscription tiers with expanded features, described on our pricing page at the time of purchase.

5.2 Billing & renewal

  • Paid subscriptions are billed in advance on a recurring basis (monthly or annual, as selected) and renew automatically until cancelled.
  • Prices are shown before purchase and may change with notice before your next renewal; continued use after a price change constitutes acceptance of the new price.
  • Payment is processed by our third-party payment processor; EmoTales does not store your full payment card details.

5.3 Cancellation & refunds

  • You can cancel a subscription at any time from the Parent Dashboard; cancellation takes effect at the end of the current billing period, and you retain access until then.
  • Except where required by law, fees already paid are non-refundable. Paid fees are non-refundable, except during any active promotional refund window.
  • We may offer a free trial for a paid tier; unless cancelled before the trial ends, it will automatically convert to a paid subscription.

06Acceptable use

You agree not to, and not to let a Child Profile be used to:

  • Attempt to bypass the Parent Account PIN or any age/content safeguard.
  • Enter personal information (such as a full name, address, or contact details) into free-text fields where not required.
  • Use the Service to generate, request, or attempt to extract content that is unsafe, sexual, violent, hateful, or otherwise inappropriate for children.
  • Reverse-engineer, scrape, or interfere with the Service, or resell access to it.
  • Use the Service in a way that violates applicable law.

07AI-generated content

📖 PLEASE READ THIS SECTION

Stories on EmoTales are generated automatically by an AI model based on a child's emoji selections. While each story passes through an automated safety filter tuned for children's content before it is shown, stories are not individually reviewed by a human before delivery. Occasionally a generated story may be repetitive, imperfect, or not exactly what was expected. EmoTales does not guarantee that every generated story will be free of errors, and we recommend that parents review stories, particularly with younger children.

If a generated story ever contains content you believe is inappropriate, please report it from the story screen or contact us — this helps us improve our safety filters.

08Ownership of stories

EmoTales retains ownership of the underlying Service, technology, and story-generation system. As between you and EmoTales, we grant the Parent Account a personal, non-commercial license to save, print, and share stories generated for their own Child Profile(s) with family and friends (for example, printing a story or emailing it to a relative). You may not sell, publicly redistribute at scale, or use generated stories for commercial purposes without our written permission.

09Parental responsibility

  • You are responsible for supervising your child's use of the Service, including setting up Child Profiles with accurate age ranges so that stories are generated at an appropriate reading level.
  • You are responsible for maintaining the confidentiality of your Parent Account PIN, which is the primary safeguard preventing a child from reaching account or billing settings.
  • You are responsible for reviewing generated stories as you see fit for your own family, per Section 7.

10Content moderation & safety

We apply automated filters designed to keep emoji inputs and generated story outputs age-appropriate, and we may block, adjust, or decline to generate a story where our systems flag a potential safety concern. We may update these filters at any time to improve child safety, without prior notice.

11Termination

You may delete your Parent Account (and all linked Child Profiles) at any time from the Parent Dashboard or by contacting us. We may suspend or terminate access to the Service if we reasonably believe these Terms have been violated, if required by law, or to protect the safety of a child or the integrity of the Service. Upon termination, your right to use the Service ends; data deletion follows Section 7 of the Privacy Policy.

12Disclaimers

The Service, including all AI-generated stories, is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. We do not warrant that generated content will always be accurate, error-free, or exactly as expected.

13Limitation of liability

To the maximum extent permitted by applicable law, EmoTales and its officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the [12 months] preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

14Governing law & disputes

These Terms are governed by the laws of [India / State of Gujarat], without regard to conflict-of-law principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of [Ahmedabad, India], except where local consumer-protection law grants you the right to bring a claim in your own jurisdiction.

15Changes to these terms

We may update these Terms from time to time. For material changes, we will notify the Parent by email or In-app notice before the change takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.
